All images remain copyrighted, you have a full personal use release, which entitles you to make prints of any size from your images included in your package and share online.
Photo License: Island Dream Productions, LLC. Grants you a non-exclusive, perpetual personal-use license to download and copy the accompanying image(s) or video(s) (collectively, “Media,”) subject to the following restrictions:
This license is for personal use only. Personal use means non-commercial use of the Media for display on personal websites and computers, or making image prints or video copies for personal use. The Media may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The Media may not be used in advertising. The Media may not be resold, relicensed, or sub-licensed.
Title and ownership, and all rights now and in the future, of and for the Media remain exclusively with Island Dream Productions, LLC.
There are no warranties, express, or implied. The Media are provided ‘as is.’
Neither Smugmug Website nor Island Dream Productions, LLC. will be liable for any third-party claims or incidental, consequential, or other damages arising out of this license or buyer’s use of the Media.
Privacy – Photos from every session will be posted to our blog and possibly our website or social media outlets. If you do not want your photos to be posted publicly, please note that you would like your photos to remain private in the general booking notes below, we always respect our client’s requests for privacy.
FEES
Client agrees to pay Island Dream Productions LLC a deposit of $50 at the time of booking to secure their appointment. The remaining balance is due at the completion of your photo shoot with cash or credit card. Client agrees to pay Island Dream Productions LLC full amount of booking to secure their appointment.
Cancellations or RESCHEDULING
We have 48 hour change or cancellation policy. If client decides to cancel the shoot within 48 hours, the deposit fee is forfeited and will not be refunded. We will decide on the day of the session whether or not we try to photograph due to bad weather.
Photographer reserves the right to cancel due to inclement weather or other issues including illness, equipment malfunction, or other circumstances beyond their control and will give you a full refund.
LIABILITY
The Photographer is not responsible for any injuries inflicted upon any participating parties that may occur during a photo shoot. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
I, HAVING AGREED TO ACT AS A MODEL, HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN THIS ACTIVITY OR EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I am physically fit, have sufficiently prepared or trained for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems, which preclude my participation in this activity or event. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity or event in which I may participate, and that it will govern my actions and responsibilities at said activity or event. In consideration of my application and permitting me to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
1) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the ordinary negligence of the provider or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: Velvet Lotus Photography and/or their owners, directors, officers, employees, volunteers, representatives, insurance carrier, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers;
2) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in the above paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of such entities or persons or otherwise.
I acknowledge that Island Dream Productions LLC and their owners, directors, officers, employees, contractors, volunteers, representatives, insurance carrier, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of Island Dream Productions LLC.
I acknowledge that this activity or event may involve physical activity, and may carry with it the potential for death, serious injury, and property loss. I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event.
I understand that at this event or related activities, I may be photographed.
I acknowledge that flash photography or strobe lights may be used during this event or activity.
I agree to allow my photo, video, or film likeness to be used for legitimate purpose by the event holders, producers, sponsors, organizers, and assigns. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
PARENT/GUARDIAN WAIVER FOR MINORS (Under 18 years old):
The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the activity or event, and has agreed individually and on behalf of the child or ward, to the terms of the accident waver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
